Municipal Court
General FAQ's
Evans Municipal Court Rules of Conduct
Do I have to appear in court for traffic violations?
If you have a payable traffic citation, you may make full payment at any time before the court date, after which you will not be required to appear. However, if you have not made full payment, or if you wish to contest the traffic charge, you must appear in court on the date and time shown on your citation. Failure to make payment in full prior to the court date, or to appear to answer the charge will result in penalties being accrued to the case.
What if I move or have changed my phone number?
It is your responsibility to keep your contact information updated with the court. Please call or email the court clerk to give your updated address, phone number, or email address as soon as possible.
What if I am unable to pay my fine?
If you are unable to pay a fine, then you will need to appear in court to request a payment arrangement. Make sure to appear in court on the hearing date listed on your citation, or contact the court clerk to set another hearing time to request a payment plan.
Whom do I contact if I need to change my court date?
To request a continuance, please contact the court clerk no later than 24 hours prior to your court date. Requests for a continuance that are received on the day of court or after the court hearing cannot be accepted.
One continuance may be administratively allowed with prior notice. Other requests for continuance may only be granted by the judge. Continuance of a trial or bond return hearing may be granted only upon a showing of good cause and only by the Judge.
Can I request phone court or a virtual hearing?
At this time, all Evans Municipal Court hearings are held in-person. If unable to attend a hearing in person, a request to enter a plea by correspondence (mail or email) must be submitted. This can be sent by email to court@evanscolorado.gov or by postal mail to the court at least 1 week prior to the hearing date for consideration by the judge.
How much will I have to pay for a fine?
For Evans Municipal Court cases, the maximum fine amount is $1,650.00, however most cases do not have that amount assessed. For payable citations, the fine amount is set by the following fine schedules. For summons tickets, marked “Mandatory Summons” on the ticket copy, the fine amount must be set at a court hearing.
You may submit your class certificate or completed community service log in person at the Evans Community Complex municipal court windows. You may also submit an electronic copy to the court by email at court@evanscolorado.gov. Please note that your electronic copy must be correctly sized and readable.
How can I request my court records?
You may request your own municipal court records for open and closed cases by contacting the court clerk. For open cases, copies of court orders, dispositions, and sentancing documents may be issued. For closed cases, a final disposition may be issued. This will include the defendant information, case number, date of the violation(s), plea information, and when and how the case was closed.
If you are requesting court case records in which you were not the defendant, you must submit an open records request through the city clerk. Charges for copies may apply.
What if my case was sent to collections?
If a defendant is trying to pay on a ticket that has been sent to collections, city cashiers will be unable to receive their payment. Instead, defendants must contact Integral Recoveries to set a payment arrangement.
How do I resolve an active Warrant?
If you have a warrant on a payable traffic ticket with no other sentence conditions, you may enter a guilty plea for the full point amount and pay the total fines and costs on the case without appearing in court. Payments can be received over the phone with a valid card number, or in person at the Evans Community Complex Customer Service windows. This will close the case, and the warrant will be recalled.
If you have already entered a plea and been assigned sentence conditions, you may pay all fines and fulfill all conditions including classes or community service in order to close the case and recall the warrant. However, if you have not entered a plea on a mandatory summons, or cannot currently complete the payment of fines and/or sentence conditions, you may schedule a court date to have the warrant recalled by appearance before the judge. Please note that the warrant will remain active until the judge orders it recalled upon your appearance in court.
